The Nigerian EIA act would be strengthened with the incorporation of key provisions of the World Bank's Environmental and Social Framework


Abstract

The Nigerian EIA Act is the Environmental Impact Assessment Act of 1992, a legislation that established the modalities for assessing the probable environmental effects of proposed developmental projects. Its main objective is to ensure that potential environmental consequences are considered before project implementation thereby, preventing environmental degradation. However, since its enactment over thirty years ago, the act has not been upgraded inline with emerging trends thereby limiting its scope of application. In this paper, we presented a comparative analysis of the provision of the Nigerian EIA and that of the World Bank’s Environmental and Social Impact Assessment (ESIA) under the Environmental and Social Framework (ESF). We recommended that the Nigerian EIA act would be strengthened if some key provisions of the World Bank Environmental and Social Framework are incorporated in the act.
