Effective public consultation process is a key indicator of successful EIA process.


Abstract

The Environment Impact Notification, 2006 contains provisions for public consultation process. The scope of the public consultation has been defined in the said notification. But the intervention of National Green Tribunal has expanded the scope of this process in various legal cases. The present paper analysis the role of the National Green Tribunal in securing right to effective public consultation process and access to environmental justice. It also analyses the trend of various orders issued by National Green Tribunal in relation to public consultations process and their impacts.

Dr. Madhuri has been working as Professor and Dean at Institute of Law, Nirma University. She has been working in the area of EIA, public consultation and Climate Justice.
